Greetings Jorge Rivera immigration attorney.

  • 1) How it was reactivated.
  • 2) When it takes effect.
  • 3) Who they affect.
  • 4) And what do you have to do now with the public charge.

 

So let's start with point number one: How was it reactivated? 
SeeThe immigration court: initially it was the district court, which is the lowest level of the federal courts that dismissed it, ended the nationwide public charge, but then immigration appealed to the circuit court (which is a higher court of the Seventh Circuit) and that court accepted the appeal; and stopped the lower court's decision.  
This means that, for the time being, the public charge, the new rules, proceed as if nothing had happened; we have to file the forms at this time. 
 
And that brings me to point number two: When does it take effect?
Immediately!...
yYou have to submit the forms and all the evidence related to the public charge: we will not escape for the time being.
-This is probably going to go all the way to the supreme court and will continue to be appealed by whichever side loses. So it's very important that you take this into account because it becomes the number one reason why they can deny your residency.
 
 
And this brings me to point number three: Who is affected? 
Affects the persons applying for residency ok? 
-It does not affect the persons applying for asylum Nor do those who apply the ten-year law, the Cuban adjustment, the Haitian adjustment, the Nacara law for salvadorans and guatemalans, domestic violence, u. visa All of these groups are exempt and do not apply to the following groups. 
But mainly if you have a family petition, your resident or citizen spouse, a parent, a child, a sibling; any family member who is petitioning you and you are going to proceed with residency, you specifically, that is the group most affected by these new public charge rules. and you have to be careful.
 
And it is point number 4: What do we have to do with the public charge? 
It is to seek legal advice, because immigration wants to disqualify all low-income people, with the excuse that they are likely to ask for government assistance in the future.
