Do you qualify for the Ten-Year Law?

The 10-Year Law exists. Many people ask me about this law. I suspect that many of them are being offered the 10-year law when they don't really qualify.

If you have been here for more than 10 years and you have parents, children and/or a resident or U.S. citizen spouse, then it is easy for someone to tell you "you qualify for the 10-year law". It happens a lot that they give you, for example, a work permit, but in the end they end up denying your case because you don't have the necessary hardship.

It is not enough to have the 10 years, nor is it enough to have the relatives, what is necessary is to have some suffering. Hhere are different types of suffering, but generally it is a physical suffering whether the parent, child, or spouse is uninhabited, has an illness, health problem, needs surgery, is in a wheelchair, etc.

Types of cases

The first case is when the person is in court. In court, if you are already in deportation proceedings, you are going to apply for nursing homes, residencesWhy? Because when you apply you can win one, two, or three years depending on when the individual hearing is. This hearing can be years after the initial trial.

The problem here is when you are not in court.You are not in deportation proceedings, you are not under the radar of Immigration and they propose a 10 year law. Because this is where the lawyer has to put you in deportation proceedings. In this case, you would be taking a huge risk, the lawyer would be bringing you under the Immigration radar and then applying for the 10 year law in deportation proceedings. If they end up denying your case, then you would end up worse off than you started.
