Today's question is: Do I qualify for immigration if I have multiple entries to the United States? The answer is yes it is possible, but we have to analyze each case independently and I am going to give you three examples:
In the first example, a person who lived on the border and went in and out all the time, immigration never caught him. That case is handled one way, why?
Because immigration does not know that the person entered and left undocumented on multiple occasions and there we are going to invoke the fifth amendment of the constitution of the right that you have not to incriminate yourself before immigration.
In the second example, we have a person who entered undocumented, was given voluntary departure and returned to the US. Generally there is no problem for that person because if they were caught and spent a short time, days or weeks in the U.S. no punishment is applied and since they had voluntary departure it is not a reentry after deportation. That person has carte blanche to resolve his or her case in the US.
In the third example, the person who entered was caught at the border or inside the country by the border patrol or ICE (the deportation department), deported and re-entered the US. Those people have less chances than the first two. But there is a possible solution: it is considered to have a re-entry after deportation, but even with a re-entry after deportation, it is still possible to have a reentry after deportation. deportation can resolve your immigration case as a victim of a crime, an assault, you were beaten, you were a victim of any type of crime or you were a victim of domestic violence and the entrances and exits had to do with violence.
