Greetings Jorge Rivera, immigration attorney.
This news has come as a great surprise to us, because we never expected this measure against immigrants. In fact, the American Immigration Lawyers Association is rejecting this change and asking the Biden administration not to implement it because it would be a "no go" for immigrants. anti-immigrant measure.
At the border, families who fail to deport because of COVID or some other reason will be placed in an expedited deportation process. deportation called "expedited removal". What does this mean? that they have no right to go in front of an Immigration Judge, and can be deported as quickly as possible. 24 or 48 hours.
The situation at the border has gotten out of hand, they have lost control. Last month 188,000 people came in, and they don't have the personnel, the detention centers, or the resources. They can't handle that number.
At the beginning of his administration, they welcomed all these people, told them they were going to have a different treatment, changes in the asylum and that they were going to be more open to receive them. But, our people cannot be blamed, they are taking advantage of the opportunity that the administration is giving them.
Now is when they want to limit and squeeze, when they see that they can't handle the amount of people that are coming in.
What other anti-immigrant changes have we seen from the Biden administration? Well, all of a sudden from May to June there has been a dramatic increase in detentions. Over 40,000 people in May and 50,000 in June. In March, there were a total of 14,000 people detained.
To be fair, with the Biden administration they have made a lot of positive changes, but not all of them are positive. Now they have started some anti-immigrant changes, and we don't know how many more there are going to be.
Our advice and recommendation is to take advantage of these good changes. Immigration is a roller coaster, it gets better and it gets worse. There are opportunities right now in Immigration Court with prosecutors, judges, in asylum, with work permits and residency. Let's take advantage of it, we don't know how many years these changes will last and what other limits they will want to impose on us.
