Greetings Jorge Rivera, immigration attorney.
There are many people asking me on social networks why they are delaying the cases of asylum in Immigration.
There are two types of asylum cases: recent and old. There was a change in Immigration, they are deciding to process the last cases they are receiving first and leave the old ones last. Why? Because what they were seeing during the Trump administration was a pattern of fraud. People were applying for asylum just to get a work permit and they didn't care how long it took.
Therefore, new cases are now denied or approved quickly and the old cases are being held over and time is passing. That is why if you have an old asylum before Immigration it will probably take years for your case to be approved. But there is hope, there is something that can be done.
Your lawyer may try to accelerate it for different reasons: for a humanitarian reason, a financial reason, it may be because a child is turning 21, or any reason that your lawyer, or we for example, may describe as an emergency. The worst thing they can say to us is NO.
Before making any decision and accelerating an asylum, we need to determine how strong your case isThere are people who think that just because they have submitted an asylum application from Venezuela, Cuba or Nicaragua, they will automatically be approved. None of this could be further from the truth, because just because your asylum is from a country where there is a lot of persecution does not mean that you will be approved, if you do not prove that you have been a victim of individualized persecution.
The best way to do this is with evidence. We can talk about a story, but how does the judge and the prosecutor know that it is not an invented story, that it is not a modified or changed story based on other stories that are common in your country? Many times with a totalitarian or communist government like Venezuela, Cuba or Nicaragua, how do they verify if what you are saying is true? There is no way, because they are not dealing with governments that are transparent.
So, when the only basis they have is what you say, it is difficult to win a case. Now, when there is evidence, for example because you were beaten, there are newspaper reports, there is a complaint in the prosecutor's office, or there is evidence of a kidnapping, murder or hospitalization, you can get asylum when it is a reality of persecution. That is what really dramatically increases the chances of winning your case.
We want to help you, before accelerating it we want to strengthen it and tell you if you really have a good chance of winning your asylum, if it is time to apply or if it is time to strengthen it and be able to accelerate the case as well.
