Greetings Jorge Rivera, immigration attorney.

We are asked this question every day on social networks, so we want to answer it.

What is delaying the U Visa?

The U Visa takes approximately 5 years because there are only 10,000 U Visas available each year. But, since many more people apply than the 10,000, Immigration knows that even if they approve it after one, two or three years, there is still not going to be a Visa available because that is the limit set by Congress. If you are waiting for a Visa, write me, I would like to know.

Immigration and President Biden's administration authorized to give the work permit while people are waiting; so they can settle their lives with driver's licenses, social security numbers, work legally and be able to earn much more.

What can you do while waiting for the U Visa?

So, while you're waiting those five years, there are five things you have to do:

  1. Apply for a work permit: This way you can be sure that Immigration will send it to you.
  2. Include your family members: can be your wife, husband, children and parents if you are under 21 years of age.
  3. Request your record from Immigration: ask for it if you have had contacts because when you are approved for the Visa it may be necessary to remove any deportation.
  4. You can marry your partner.
  5. Ask for forgiveness: that will speed up your whole process.

The work permit will arrive in less than a year approximately. We have already started to receive the approved work permits from the people who have their work permit pending. U Visaso this is very good news.
