Greetings Jorge Rivera, immigration attorney.

There are many questions and confusion about who can petition you. In this article, I will explain all the details about which relatives can petition you with immigration, so that you won't be left in the slightest doubt.

Parents

Resident parents or U.S. citizens may petition. The only limitation is that a resident parent cannot petition for a married child, but they can petition for minor or older children. So, unless you are married, only a U.S. citizen can petition for you.

Sons

U.S. citizen children may petition for parents, but they must be over 21 years of age. The parents when they are going to be petitioned, it does not matter if they are single or married, with or without siblings. However, siblings must be petitioned independently, they cannot be included in the petition for your parents. Also, the request for the father is independent of the request for the mother. It is very important to keep that in mind.

When it happens that the children ask for the parents, it is because they entered undocumented or they entered legally. If they entered legally, it's easier. If they entered undocumented, there are seven different combinations in order to be able to to arrive at the residence.

Wives

A resident wife or U.S. citizen can petition for her husband. The interesting thing is that the waiting time is the same. Now, there are differences in the legal stay.

When a spouse is going to ask you for a U.S. citizen, the only thing that matters to make you a resident in the country is legal entry. When a spouse asks you for a spouse you need to have a legal entry and stay to become a resident within the U.S. If you do not have the legal stay, even if you entered legally, you need a pardon within the country to go pick up the residency at the U.S. Embassy.

Brothers

Siblings do have to be U.S. citizens, and you can petition for older, younger and unmarried siblings. Here if, when you petition for a sibling, you automatically include the spouse and children.
