What is the latest on TPS?

This note is being recorded on May 4. Lhe last thing is that we have yet to hear from the White House, i.e., from the administration of Joe Biden extending the TPS. What is official, and what is published on the Immigration page, is that it is extended until October 4.

However, it was not because of orders from the White House, but because of pending lawsuits in Federal Court. This is why Immigration has been forced to extend it on October 4.

Alternatives with the TPS

We do not know what immigration will do if these claims remain pending. It is possible that they will extend it until the next year, but at the moment we are in legal limbo. The latest extension we have for Honduras, Nicaragua, El Salvador and Haiti, countries in the Americas that have TPS, is that it expires until October 4.

So, the challenge we have at the moment for people with TPS is to find alternatives that give you a better chance of getting a better life. work permit and a residence.

Travel permit

Permission may be requested from travel, but remember: the travel permit that gives you the equivalent of a legal entry is the one that is granted if the person traveled and entered the U.S. before the August 20, 2020. If you applied for a travel permit and returned to the U.S. after that date, it no longer counts as a legal entry.

This means that, today you can ask for a travel permit, leave and enter without any problem, but you can no longer use it as a legal entry to become a resident based on the family petition of a child or a U.S. citizen spouse.

States with exceptions

Remember: in the Sixth, Eighth and Ninth Circuits, which includes the State of California, just having a legal entry and TPS counts as a legal entry and stay. This case is currently before the Supreme Court, which has not made a final decision.

For the time being, let's take advantage of the opportunity to present these residencies if you have TPS in the States.
