Greetings Jorge Rivera, immigration attorney.

Immigration reform

Currently, the President Joe Biden's pledge to provide a pathway to residency and eventual citizenship no longer exists, we are no longer talking about a residency or citizenship. We are only talking about a temporary benefit which is a work permit, protection against deportation and legal stay.

Basically, they didn't have enough votes to pass the residence and the citizenshipand they have been left with something temporary that is similar to the TPS or the DACAbut it has not yet been approved. The House of Representatives if it was approved, i.e., half of the CongressThe Senate still has to approve it, and that is the most difficult part.

What is missing in the Senate for this to become a reality?

They have to publish an economic impact report, give a work permit to more than 7 million people who entered or have been in the U.S. for more than 10 years. Once they have that economic impact report then three senators are going to meet with Elizabeth MacDonough, Member of ParliamentThe Senate, which is going to decide whether they can include this proposal, this Plan C for Immigration, in the Senate.

In President Biden's infrastructure, they will be meeting with Chuck Schumer, Bernie Sanders and Alex Padilla to try to convince the parliamentarian to establish Senate rules that would allow it to be included. The problem is that this lady has already rejected them before, saying that legalizing millions of people is more political than economic.

If she doesn't accept it, the Democrats can't get anything done, because John Manchin, the Democratic Senator who doesn't always vote with the Democrats, has said that he is not in favor of going over Elizabeth MacDonoough.

What happens if it is not approved?

If it is not approved, then there will be much to do for these three reasons:

  1. There are currently more than 20 different ways in which you can become legal.
  2. Under President Joe Biden's administration it is easier to get your papers out.
  3. Throughout the last few administrations, the Bush, Clinton, Obama, Trump, Biden administrations without immigration reform have been approving over a million residencies a year.

Therefore, if Congress does not act, we have to act. As lawyers we want to help you.
