We are celebrating with the Venezuelan community that has been waiting for years for this important TPS benefit, and we are going to talk about the most important thing:
Let's start with the dates. Immediately as of today, March 9can now be applied. The registration period will last six months. 180 days for Venezuelans to register.
In turn, the TPS will last for 18 months starting today, March 9th, until September 9th, 2022. Therefore, it is ample time to enjoy the benefits of TPS.
In order to qualify, the person must have been present as of the March 8, 2021the day TPS was announced. If you were not present yesterday, then you will not qualify.
This is very important because you will need proof that you were present on the critical date.
The important thing is to prove that you are a national. You have Venezuelan citizenship, or you were residing in Venezuela and had no nationality before coming to the U.S. Then, physical presence is important.
TPS actually forgives all immigration violations. But, for criminal record you may be disqualified if you have one felony or two or more misdemeanors. A felony is a felony, so you have to be careful if you have a criminal record. We are going to check those records and verify that everything is in order.
There are four benefits that Venezuelans will enjoy: legal residence, protection against deportation, work permit y travel permit. Does not include the residence. The TPS does not lead to residency, i.e., it can be used as a first step, but not as a path to residency.
It is very important that you always talk to your lawyer. For the registration as well, because what we don't want is that you make mistakes, miss the opportunity, have any problem, get lost, get delayed or have any setback.
Over the years, we have seen many cases where paralegal notaries or paperwork fillers made mistakes with the person's own TPS application. Then, the information they put on that application is used against you to accuse you of some type of fraud or irregularity. In the end, the information does not match later, when you apply for residency, which is what we are most interested in to have a permanent stay in the United States.
For all these reasons, don't risk it.
