This news sounds great, but not everyone qualifies. The Cubans must meet certain very specific requirements in order to qualify for residency:

  • They must have applied for the residence and have been denied.
  • They must belong to what Immigration refers to as "...".Arriving aliens"a special category of people.
  • They must have been detained and released by Immigration between January 12, 2017 and November 17, 2021. There is a four year period during which if Immigration released them, they applied for Cuban adjustment and were denied, if they were considered "Arriving Aliens", then they can appeal or apply for residency.

Specific notification

I tell you all this because the notification is very specific. Thousands and thousands of Cubans qualify but not all of them, for example, someone who arrived after November 17, 2021 even if he/she is an "arriving alien" or even if he/she has been released will not be able to qualify for this benefit.

You have to qualify based on all of Immigration's requirements: having applied, having been denied, having been released during the immigration time period and having been considered an "Arriving Alien". If you meet all of these requirements you can appeal or reapply and the time you have to do so is specifically one year after this notification.
