Stages of the deportation process

There are millions of people who are in some stage of the deportation process, whether in a first stage, a second stage, or a third stage. What does this mean?

  • 1st Stage: people who are entering deportation proceedings and have never been to court.
  • 2nd Stage: are already in the middle of their appointments in front of the judges and have to present their arguments.
  • 3rd Stage: have a final order of deportation, are in detention or have already been deported to their home countries, and have returned.

Imagine the number of people who fall into these categories, people who are at some stage of their lives. deportation. However, hew solutions.

Final order of deportation

If you have a final order of deportation, the solution will depend on whether you qualify in or out of the country.

If you qualify for a residence within the countryFor example, if you entered legally, or you are going to ask for a U.S. citizen spouse, we can reopen your case. If you qualify out of the country, then we are going to do an I212 waiver, in combination with one called an I601 waiver. The I601 is used if, for example, you are going to be petitioned by a resident parent or U.S. citizen and you have to leave.

In conclusion, there are two solutions if you have a final order.
Y, ¿
if you don't qualify for anything? For these cases, et is the deferred action, which can give you a work permit.

Detention

For the people arrestedThere are several alternatives with new memos from Joe Biden's administration. Bail can be requested, for example, from prosecutors, or in other cases from the judge.

You can also order something called discretionThe "Health and Family Emergency Release," which is like an umbrella of things that can be requested to release people for health, family, COVID, or any other type of emergency.
At present, there are many reasons why they are freeing people.

Immigration Court

Now more than ever, there are options and alternatives for people who present themselves at the Immigration Court. Last week was that, they were allowing to close the cases.

In addition, you can ask that it be dismissed, terminated, or expedited; and in turn, that they not appeal or put you in deportation proceedings. There are 7 different things we can ask prosecutors and judges. With the new guidelines from the Biden administration we have a lot of flexibility.

What will define whether you win or lose your case?

What will define whether you win or lose is the person you choose. If you choose a notary for legal or paperwork, they cannot represent you in court or before the Attorney General's Office. A notary cannot sign a power of attorney, which is a requirement to represent you.

On the other hand, when choosing a lawyer, you should choose someone who specializes in deportation. The best option is to have a deportation lawyer who has handled thousands of deportation cases at all stages, who can tell you the percentage of cases he wins and how often he appears in court.

We are a firm of 27 lawyers. At any time of the day or week, we have attorneys in Immigration Court. We have lawyers who work with thousands of deportation cases, and with people in detention. We have the experience, we know how to get a detained person out of detention, resolve your case if you are deported and win your case if you are in court.
