Which cases are being suspended?

They are suspending indefinitely the cases that are not detained and that do not have lawyers. We use the word "suspension" because they are canceling these hearings and are not giving us dates for new ones. They say it is all because of the OmicronThe Court is being consulted with the health authorities, that is, for the health conditions of Covid-19 contagions. Everything else is being consulted with the health authorities, and when it is feasible to reopen the Court for all these cases, they will do so.

Which cases will not be affected?

If you have a immigration lawyer in your court case, the case will proceed, only that the hearing will be by telephone or virtually; this will also be the case if it is a person who is detained.

How long will these cases remain suspended?

We don't know, and that's the problem. This can turn into months and months of additional backlogs, when we already have over a million cases in Immigration Court. This is something that is not getting better, it is getting worse.

How can we take advantage of these backlogs?

This stay gives pause to all those people who do not have lawyers to consult whether it is in their best interest to have their case suspended indefinitely and see how long they will be given a hearing on their weak case, or, whether it is in their best interest to push the case because they qualify for something and want a hearing as soon as possible.

At the time they hire an attorney, they may request that the date of the person's hearing be set.
