Greetings Jorge Rivera, immigration attorney.
This is a very common question I get asked in interviews and on social networks. And the answer is YES, definitely, there is not the slightest doubt.
A resident spouse or U.S. citizen you can make the request. If you entered through the border, you can ask for a pardon, the I601A, within the U.S., which forgives you entry and legal stay. Pero care, only forgives you for that. Nor pardons you for crimes, fraud, human trafficking, impersonating a U.S. citizen, etc.
The I601A waiver is for these two things only: lawful entry and lawful stay. It also gives a lot of peace of mind to people who have no other violations. People whose only violation was to enter through the border, remain undocumented, get married, fall in love and be asked by their spouse. The pardon here is done within the country and goes to the American embassy.
If you have more immigration violations, you will have to present other waivers when you go to the U.S. embassy.
I would like to present a question I was asked on the Facebook Live I did recently. A man tells me about his case:
"I got married in 2013, 7 years ago, to my citizen wife. I entered undocumented, I have a clean record, but I went to a lawyer and he told me that I didn't have the necessary suffering to be approved for a waiver.".
A serious mistake that caused you to lose 8 years, from 2013 to 2021 from your case. Why? It doesn't matter that you don't have an illness or health problem. A family separation is going to be devastating for the entire family. In these cases you are going to have serious emotional problems, a large suffering. EThis is the argument supported by affidavits and a psychological evaluation. Thus, we have been successful for many years in winning these cases.
This is why you cannot have a lawyer who is fearful, afraid of forgiveness or who does not have the necessary experience. You need to find the right lawyer. We can fight for you.
