How to request your immigration record

Immigration lawyers Jorge Rivera > Blog > Asesoria Immigration > How to request your immigration record

Greetings Jorge Rivera, immigration attorney.

Record immigration

In order to know how to get an immigration record, we have to ask two very specific questions: who needs an immigration record and who does not. In addition, we will see which records should be requested. We will provide details, tips and solutions below.

Who needs and who does not need your record immigration?

It all depends on the contacts you have had. If you had contact at the Border with deportation or in Immigration Court, we will have to ask for your record. Now, if you had contact, but were not caught by immigration at the border, never applied, and never went to court, then don't worry about your record, you can apply directly with immigration.

What records do you have to ask for?

There is four different basic records that must be requested with immigration. To this, we must automatically add two more. These records correspond to the contacts you have had with immigration.

  1. FOIA with CBP: The first contact someone is going to have if they entered undocumented at the border is precisely at the border with the Border Patrol. This is the first record you have to ask for if you had contact with them.
  2. FOIA with ICE (deportation department): Then already inside the country, the question is: did you get caught in a raid, did they catch you? at deportation, at ICE, at your job or home, on the street? These are ICE records that can also be requested.
  3. FOIA with USCIS: The third is the rrecord immigration service if you applied.
  4. FOIA with EOIR (immigration court): If you had anything to do with an Immigration Judge in court, whether you were cited, denied, or ordered deported. The first four are then named and two more must automatically be ordered:
  5. Fingerprint check with the FBI check your fingerprints and all contacts appear. This serves as a double check in case they do not appear in the first four.
  6. OBIM fingerprint check: fingerprint check with the immigration service. All contacts are also displayed here.

Alien Number

There are many people who do not have their A number.lien (identification number). And if you don't have itHow are they going to ask for them at immigration? This is why the fingerprint check is done first. In the check the A number comes out.lien. Then with that, you asks for the record.

However, some it is not in their best interest to ask for their record because they have a deportation. We are talking about more than a million people in immigration court. Over the years, how many people have not been through immigration court? Millions. How many don't have a deportation at the border?

It is not in their best interest to be asking for their record on their own. because they would be giving your address to immigration, which can come and pick you up at your house. This is why we, as lawyers, never give out our clients' addresses. We ask them to come directly to our offices, where we review them and give you the necessary legal advice.

Call us for help with immigration. Don't order your records alone. Hire a intermediary, a lawyer who will ask for them, analyze them and advise you.
