Greetings Jorge Rivera, immigration attorney.

This is a topic very interesting both for the young people under the age of 18, as well as for those under 21 in certain states. 

How does the process work?  

Many people think that the Youth Visa is only for young people who come alone, without their parents. This is not true. It qualifies in most states, only if the child comes with one of the parents. If the other parent stayed in his or her country, he or she can qualify.  
 
The first step in the process is to get an order from a Family Court, with a Family Lawyer that says the youth is abandoned or unaccompanied by a parent. We work with Family Lawyers all over the United States to get those orders. As soon as we get that order, which is like a family court declaration, we use it to apply for a unaccompanied youth formthe Youth Visa, or form I360.

Once we get that approval, we have to wait for a Visa number to become available, which usually takes less than two years. Then, we can proceed to obtain residency, either in Immigration Court or with the Immigration Service.  

Many young people are in court proceedings. This is where it is important that your attorney, or we, can help. Let's be very strategic in deciding where to proceed: whether in front of the Court in front of a Judge or with the Immigration Service.  

It's all about timing

We have more control in court, but if the hearing is going to be too far away we prefer to terminate the case and go before the Immigration Service. We have those two options.

The key is, if you have an immigrant youth under the age of 18 or under the age of 21, your attorney, or in this case us, is going to be exploring possibilities. Asking you all the necessary questions to see if you can qualify as an abandoned youth for a Youth Visa. Whether you are with only one parent inside the country, or both parents are outside the country.  

There are many possibilities. The laws change from state to state because Family Court has to be involved. The good thing is that we are with you from start to finish. We don't abandon you at any time until you are able to obtaining residencyeventually citizenship and then you can ask your parents as well.
