This is a question asked by many people who want to marry for love with a U.S. resident or citizen. And the answer is YES, they can apply immediately.

It does not really depend on the date of marriage, a couple who have two or three children and have never been married, can now proceed with the residence.

It all depends on what evidence you have, or how many years you have been together. That's the kind of evidence that we're going to be presenting to Immigration. There is no time rule that you have to wait one, three or six months, no! You can do it immediately, because Immigration knows that there are couples who have been waiting years to get married and file their papers even though they have been together.

Timeout date

What you do have to take into account is the lead time date.This is when the person has entered with a Tourist Visa, gets married and wants to file the papers.

Our recommendation is to spend at least three months after entering the U.S. to get married. Do not let Immigration think that the person did not intend to come as a tourist, but that he/she intended to come to get married and stay. Then you can be charged with fraud.
