How can a citizen child help me with immigration?

Immigration lawyers Jorge Rivera > Blog > Asesoria Immigration > How can a citizen child help me with immigration?

Greetings Jorge Rivera, immigration attorney.

There are different ways in which a citizen child can help you with Immigration.
The first question is: are you under or over 21? Because there are different options. If they are a minor, there is the Deferred Action option, the Ten Year Law, and PIP (problem place) when the children are in the armed forces. If over 21, there is the option of the Petition.

It doesn't matter if you entered undocumented, there are solutions and combinations to get you to residency.

If your child is under 21

Your children join the armed forces in order to get a scholarship and be able to study. In that, they benefit them, but, they would also benefit you. They can give you: a work permit, legal stay and legal entry. This is called a Parol, and is very important, because when they turn 21 years old, they can ask for you.

According to the options of Deferred Action and the Ten Year Law, what we will do here is look for a hardship. Suffering that justifies it, exceptional and/or unusual. That is, special suffering, which is usually something physical.
With deferred action you get a work permit for humanitarian reasons. With the ten-year law, if you qualify, based on a U.S. citizen child under 21, can take you to the residence.

Deportation proceedings

If you are not in deportation proceedings, we look much more closely at these cases. We evaluate them delicately because we don't want to put you in deportation proceedings to ask for the Ten Year Law if there is not enough suffering. We don't want you to deny the case and you end up deported. You see a lot of scams with that.

But, if you are already in deportation proceedings, then it is different. Ahether it is weak your ten-year law case, asylum is taken. Court proceedings take years, and once you tell the judge what benefit you are applying for, it can earn you one, two, three years or more of waiting while you get your turn for an individual trial.
So, for the ten-year law, you have to take into account whether you are already in the court process.

U-Visa

There is another small alternative, if your children are under 21 years of age. This alternative is the U-Visa.
If your child is undocumented, it's easy, because if he or she suffers abuse, mistreatment or
bullying, qualifies the child as well as the parents.

However, if your child is a citizen, is a young child and suffers some type of abuse, a U-Visa can be issued to the parents. All you have to do is get the signature of the authorities on the U-Visa supplement, documenting that it was the parents who cooperated with the criminal investigation.

This is the case when we are talking about a five-year-old child, for example, who would find it impossible to report the crime himself. The parents are the ones who would facilitate the criminal investigation, where the police and the parents would sign. This is when they may qualify for the U-Visa.
This is for you to see that we, as lawyers, always look for exceptions so that you can be eligible.

If your child is over 21

The largest category of persons, which are those who have children over the age of 21 U.S. citizens.
If they entered legally, it is easy, but if they entered undocumented, it is more difficult. There is seven different combinations to solve the problem in the case of parents who entered undocumented and are asking for their children.

Do not be discouraged. Seek help, because there are solutions even if they entered undocumented. You can petition for your citizen child over 21, or there are also options for children under 21 who are citizens.
