Greetings Jorge Rivera, immigration attorney.

The friday, august 20The blockade of these initial limits against the administration of Joe Biden. Those limits spoke to the fact that they were only going to stop and deport to those people who are terrorists, spies, newcomers, or criminals.

Then, the number of people who were allowed to ICE could detain, but they blocked those limits. This means that as of Aug. 20, ICE was free to detain anyone who violated the limits. Immigration Laws. Now, however, the blockade was lifted on August 23rdThe President, on a Monday, and Immigration was given 7 days to appeal. During those seven days the president's limits continue.

This means that, at the moment, until August 30 we do not know what is going to happen, but before that date, Immigration and ICE cannot detain people who have violated the Immigration Laws and are not part of these priorities.

In what cases can you be detained or deported?

If you are part of the priorities, you can be detained and deported. Those priorities are terrorists, spies (because they are a threat to the National Security), newcomers (as of November 1, 2020) for being a threat to the Border SecurityThe following are not considered to be felons, or offenders who have committed serious crimes (such as being a threat to Public Safety).

Excluding these situations, all other persons who do not fall into these three groups will not be detained or deported at this time.

So we are saved. We have a few days until August 30 and we'll see how it works out. A single detail is that the Federal Judge in Texas looks pretty aggressive against President Joe Biden's policies. He can make the decision to keep that blockade in place and give ICE the freedom to detain more people. That's precisely what we don't want.

In the meantime, in the midst of all this coming and going, the key is to have a good defense, a good legal representationA lawyer to help you navigate all these changes, take advantage of the good and discard the bad.
