These tips are extremely important so that you do not get stranded in your country when you leave for the American Embassy.
The family request whether it is for a spouse, parent or sibling will be approved, you will be approved while you are in the US. Also the waiver for having entered undocumented or having been undocumented in the country. That waiver is called "I601".
However, there are other reasons why your case may be denied, reasons that may come as a surprise to the U.S. Embassy. Some of them are, for example: problems at the border: if you were detained at the border, deported, or had undocumented entry contact with Immigration.
So, the first advice is to investigate to see if there is a deportation, voluntary departure, punishment or something like that to be forewarned.
We need to see if you have ever missed an immigration court date, because you may have been approved for an I212 waiver. deportationYou must give a justification for missing that appointment. This justification is requested at the American Embassy and you must be prepared to give it.
I recommend you and your lawyer to prepare an affidavit, that is what we do with our clients so that you have it up your sleeve in case you are asked for it at the Embassy.
My third piece of advice is, if you entered the U.S. with children or a family member, you can be charged with human trafficking. In this case we would also need to ask for a waiver. You need to be prepared if you are charged with this.
If they suspect with your tattoos that you are a member of the Mara Salvatrucha or any other gang from Central America or Mexico, they may deny your case. There are people who erase their tattoos, they paint them to remove any doubts that they may be a gang member.
If you have a health problem, such as tuberculosis, and it shows up on your medical exam, they may require treatment and it will take a while. If you take drugs or have taken drugs in the past, like marijuana or something like that, and it shows up in your blood, then you can be denied as well.
Be very careful with crimes, as you may have committed one in your country and we don't want this to come out as a reason for them to deny your case, ask you for a pardon, complicate it and you are left out in the cold.
