Who must apply for your immigration record?

Immigration lawyers Jorge Rivera > Blog > Asesoria Immigration > Who must apply for your immigration record?

Not everyone has to ask for their immigration record. If you entered legally and have never had any problems, what record should you ask for? Now, if you entered through the border undocumented and you were detained, of course you should ask for the border patrol's record. If, for example, you were detained in a raid, either on the street, at your home, or at your job.

In these cases we do have to request the immigration record from ICE, to see what happened to your case. If you were taken to a detention center, released on your own recognizance or deported. In other words, we need to know what the consequences of those detentions were, because it may be necessary to ask for a pardon, for example, or to reopen your case.

Then, it's not just the border and ICE service if you were detained inside the country that are important. What if you applied for something and were denied? It is worth finding out what happened. Why? Because if you were denied a case you may have been sent to court. What if you never got the notice, have a deportation order, and are detained in a future interview?

In any case that you have applied and were not approved, it is important to ask for that record. Also, if you went to immigration court you need to know what the judge decided.
We can call the court and find out, or log into the system and put in your alias. Et is important to find out what the judge's decision was, the whythe how, and that you presented. All the details of the court.

Which record should you ask for?

In short, there is the border record with the Border Patrol. The ICE record if you were detained inside the country. The USCIS record if you applied for a benefit; and the EOIR record if you went to immigration court. To that we have to add two more records: the FBI record and the OBIM record, which is the internal immigration check.

There are times when we ask for a record from the border patrol, from the immigration service or ICE, and nothing comes back, we can't find it and we have to appeal. And those appeals are often made with the FBI record, that if they find that you have been fingerprinted, or that there is a deportationyour record is displayed.

So, we submit the FBI or OBIM record when we go to make that appeal, and so, we manage to get the record.

There is one record that can be requested but usually sends practically nothing, which is the state department record. We have stopped wasting time asking for the records of the department of status.

PBut yes, we ask for all the others, to see the contacts you have had before applying. So that we don't have any surprises, complications or problems in an interview and you are going to be denied. DThis way we increase the chances of winning your new application case with immigration.
