Greetings Jorge Rivera, immigration attorney.
Let's look at the 11 million people who do not have their papers in the country and who fall into two groups: the group that will resolve, even if they have not passed immigration reform, and the group that will not resolve. Now, What distinguishes them? What is the difference?
Those who are going to solve are those who seek help, do not give up, take a first step, make a last attempt and something different from what they have been doing in recent years. That is the difference.
Not at the moment. The door to immigration reform has been closed by two people:
Elizabeth Macdonough: the Democrats' reform plans (Plan A, B and C) three times, and neither the work permit wanted to include it in the budget reconciliation.
Joe Manchin: the only Democratic senator to decide to go against the Build Back Better PlanThe infrastructure plan, where they refused to include immigration reform, was stopped because the Democrats could not agree on it because of this senator. Everything was paralyzed because the Democrats could not agree on this senator.
In 2022 we have congressional electionsThere is talk that there may be a change of power in the Senate and in the House of Representatives for different reasons: inflation, rising gasoline prices, the shortage of products that we see in the stores, Afghanistan, too, etc. Different reasons why there may be a change.
If there is a change of power, they may begin to block the executive actions of the President Joe Biden that have helped immigrants; pro-immigrant, pro-immigrant actions, they may try to block them.
So 2022 is a year that we have to take advantage of, because if we don't take advantage of it we may be blocked from making pro-immigrant changes by President Biden.
They can still settle their cases even if they have refused to accept the immigration reform. Historically, approximately one million people have managed to become residents every year, which represents 10% of the population that does not have their papers in the country.
The challenge for 2022 is to be part of that 10% of those million people who are going to resolve their residence within the country. If they seek help it will be much easier to solve, much more likely to find a solution. If they don't seek help they will probably stay the same as they are now without any change.
