The first thing I want to tell you is that the vast majority of offenses, crimes or records that you may have as an immigrant do not disqualify you or have a pardon with immigration.

"Misdemeanors: Misdemeanors

Because misdemeanors are the most common crimes, known in the United States as "misdemeanors". Generally they do not require a pardon and if they do, immigration can pardon them.

Examples:

  • If you have committed a petty theft of less than $500 it is known as a "misdemeanor" and a single arrest for this type of theft does not disqualify you for residency.
  • Generally a DUI does not disqualify you; there are exceptions and DACA is the perfect exception. If you have a DUI (driving under the influence of alcohol) it disqualifies you for DACA. So it really depends on what benefit you are applying for.
  • If you have a DUI in the last five years it disqualifies you, but for no other benefit does driving under the influence once disqualify you.

The key here is that you consult with your lawyer, we can help you.

The first step is to request your police report or arrest report and the disposition (judge's decision). Many times people are arrested and end up having the charges dismissed and there are no immigration consequences.

So you have to look at the records and you have to see if the crime committed requires a pardon, because it is possible to have an automatic pardon, if it requires a pardon it is done. It is only a small percentage of criminal cases that do not have a pardon such as drug trafficking, murder, child abuse, etc.
