You have to know if you can travel inside and outside of the U.S. as an immigrant 0 resident. Many immigrants in the united States have doubts about whether they can travel, either within the country or abroad, without jeopardizing their immigration status. Is it safe to do so if you're undocumented? What if you are a permanent resident, or have TPS or DACA? In this article we explain everything you need to know to avoid problems with immigration and travel with peace of mind.

CAN YOU TRAVEL WITHIN THE UNITED STATES AS AN IMMIGRANT?

✅ 1. Travel within the U.S. if you are an immigrant

Although technically you can travel within the country with your valid passporteven without a Real ID, this is not recommended if you are undocumented. Here's why:

  • TSA (airport agent) are part of the Department of Homeland Security (DHS), as well as ICE.

  • If you are undocumented, with a history, deportation or release pending, TSA could alert ICE.

  • This has resulted in detentions at airports within the country.

📌 Recommendation:

If you are undocumented, do not travel until you obtain a work permit or some kind of relief migration. We can help you to regularize your status before you travel and avoid any risk.

CAN I TRAVEL OUTSIDE THE U.S. IF I AM A RESIDENT?

✅ 2. Travel as a permanent resident

If you have a green card, you can leave the country, but you must meet the following requirements:

  • Your card must be current.

  • You must not have a criminal record or deportation, or even prior to obtaining the residence.

  • You should not be out of the country for more than 6 months without a valid excuse.

  • More than a year out can lead you to a process of deportation.

📌 Recommendation:

🧾 Carry supporting documentation if you have any problems in the past, as defectors from charges or waivers approved.

CAN I TRAVEL OUTSIDE THE US WITH TRAVEL PERMIT?

✅ 3. Travel with a travel permit (Advance Parole)

If you don't have a residence, but accounts with the TPS, DACA, asylum, approved, or you are applying for the residence, you can travel with a travel permit approved.

  • Everything must be current and in good standing.

  • You must not have a history, fraud or deportations active.

  • If you meet these requirements, you can leave the country and return without problems.
