Greetings Jorge Rivera, immigration attorney.

In this opportunity I am going to explain everything you need to know about this issue, because many immigrants have traffic violations and want to know if this is going to affect them when they become residents.

Consequences for civil violations

Generally traffic violations are civil, not criminal. The only consequence for any civil violation is a fine, it does not have a criminal record. Therefore, it should not affect you in the least, as long as you were not arrested. Remember:

  • Traffic violations can lead to an arrest when one is driving and speeding above 120 miles per hour.
  • Driving under the influence of alcohol can lead to an arrest and has criminal consequences.
  • People who drive without a license and do so repeatedly may have a criminal record, i.e., an arrest by the police, which forces you to go to court. In this case you will need to file that arrest report and final disposition with the Immigration Court.
There is no penalty for driving without a license that disqualifies you for the residence.

This means that if you drive without a license, under the influence of alcohol, speed, or pass any traffic arrest, Immigration will not ask for a waiver.
