This is a question I am frequently asked on radio, television and social media. The answer is: Yes! There is a ten-year law. If you have been here for more than ten years and have resident or citizen parents, spouse or children, you can apply for the ten-year law. However, it is a double-edged sword and you have to be very careful because there is a lot of fraud surrounding this law.
The lawyers tell their clients "if you've been there for ten years and have a resident or citizen relative, you qualify". However, they don't tell them about the suffering.
Generally, what we look for in a good suffering that qualifies for the ten-year law.is physical. For example: Your wife is in a wheelchair; a child who has cancer, a stroke, heart problems. In other words, something life or death, strong, that justify the suffering necessary to get your case approved.
The problem is when there is no disease of any kind, no health problem of any kind, and they still open the ten-year law case for you. The case will be super weak, and will probably end up being denied.
There is a solution: Today with all the discretion that judges and prosecutors have, your immigration attorney or we can help you close your ten year law case and continue with your work permit.
They do not complete your deportationIt's not a dismissal, it's not that it's eliminated altogether. It is closing the court process and that way we have a chance to continue with the work permit, but not continue with the ten year law if your case is weak.
