What we know at the moment is that people who entered before 2011 will qualify.The only people who will qualify are those who have been in the U.S. for at least 10 years. People who are undocumented, people who have a final order of deportation, with multiple entries and exits will qualify.
Why can I tell you all this with such certainty? Because the above proposals and the laws that Congress has passed for the general population of immigrants who entered before a cut-off date, (e.g. for Haitians; the Nacara Act for Cubans and Nicaraguans, etc.) have forgiven the deportationhave pardoned the violations at the border.
So, it is anticipated to have a very broad waiver that will forgive most immigration violations, so that people who entered before 2011 can qualify. If they start putting restrictions in place, they will remove the millions and millions of people who have committed various immigration violations.
If you entered before 2011, we anticipate based on the history of similar laws passed by Congress that you will qualify despite the vast majority of immigration violations.
