The uncertainty has taken hold of thousands of immigrant families, after a recent decision of the U.S. Supreme Court, which limits the power of federal judges to issue blockages national.
Although it has not been revoked right to citizenship of children born in the U.S. to undocumented parents, the future of this benefit is at stake. What you need to know and how to protect your family?
On June 27, the Supreme Court decided to restrict the ability of federal judges to issue orders of the court with national effect. This directly affects the locks that had been imposed by executive order of the administration Trump, who seeks to deny the citizenship to the children of undocumented immigrants born on u.s. territory.
During the 30 days subsequent to the decision —until the 27th of July— citizenship by birth, is still in force, thanks to a court order still active in 22 states. However, in the other 28 states where there are no locks federal government could begin to deny citizenship to these children from that date.
Lawyers and advocates for the rights of immigrants now have less than a month to file lawsuits in states without protection. If you manage to set locks in additional state or a demand collective national (known as class action lawsuit), could temporarily restore the citizenship by birth to the national level.
Already efforts are underway in states like Maryland and New Hampshire to achieve that certification. If successful, it could even have a retroactive effect in cases where they are denied citizenship.
The Supreme Court will hear in October, the arguments on the constitutionality of the denial of citizenship to children of undocumented immigrants. This final decision would be national in scope and could void the locks-state current. It all depends on if you acknowledge the constitutional right to citizenship by birth.
