Greetings Jorge Rivera, immigration attorney.
It is not yet law, it still needs to be approved by the Senate, but a good first step is that the House of Representatives has approved this work permitwhich provides us with legal stay and protection against the deportation for 6.5 million people who entered before 2011.
This is good news, because they will have this work permit for five years and they will be able to renew it for another five years. The reports tell us that approximately three million people are going to be able to achieve the residence.
All of these benefits are being provided through a process called "Humanitarian Parole".which is the equivalent of legal entry. This means that half of the immigrant population within the U.S. who have U.S. citizen children will eventually be able to petition for them when they turn 21. In addition, we will be able to combine them with the equivalent of legal entry. This is when they will be able to apply for residency.
So we have great news! But be careful, because we can't make sure that they don't cheat you, or commit any kind of fraud, because the permit is halfway through Congress; the Senate has to approve it. This is where we have certain obstacles. The three main ones are:
The first obstacle is Elizabeth Macdonough. The MP has rejected the legalization of millions of people twice already, and may do so a third time, we do not know.
Joe Manchin y Kristen SinemaOur second and third hurdles are two Democratic senators who do not always vote with the Democrats. If they don't support these immigration proposals within the "Build Back Better Plan" from Joe Bidenthen it will fall by the wayside, and it will not become a reality.
Kristen Sinema has said that she does support the inclusion of a migration planbut Joe Manchin did not. So this is still in question, in question, and with no guarantees. We'll keep you posted because remember: it's easier to find an individual solution than for the entire country.
It is very important to seek good legal advice, because remember, this is not a residence or a citizenship, this is just a temporary benefit such as DACA or TPS. That is why it is so important to find that plan, strategy and individual path to residency.
