Millions of people waiting in court

Such a high figure has never been reached before in the history of the Immigration Court. That's almost 1.6 million people who are waiting in court for their hearings and a final outcome. The problem is that the situation is not getting any better under the President Biden's administration.

Last year, from October to December 2021, 140,000 cases increased in the Immigration Court in just three months. So far in 2022, if we continue like this, in the first part of this year more than 800,000 cases have increased. In other words, we will quickly break the record of two million cases in the Court.

They don't have the capacity, there are not enough judges and not enough Courts. This is getting worse. Immigrants have to wait years to see a resolution of their case, which is unusual, but we can take advantage of these waiting times, these years that they have to wait.

Strong and weak cases in Immigration

The immigration lawyer has to advise the immigrant and tell them if they have a strong case with a good chance of winning or if they have a weak case, because that makes all the difference in the strategy.
If you have a weak case, as is the situation for a large percentage of people, it helps to have to wait so long. We have the alternative of dismissing the deportation process if they are not a priority.

People are only a priority because they are terrorists, criminals, delinquents or newcomers. So, it's a valid argument that you don't have to worry about the court anymore.

But there is the other side of the coin, there are those people who do have a good case for the residencegood chances of winning a asylum based on the evidence, a strong enough hardship for the ten year law or to get a waiver in Immigration Court. Those people are the ones who need to ask their attorneys to help them get a hearing as soon as possible in order to receive an approval.
