Greetings Jorge Rivera, immigration attorney.
If you are applying for the residence or you want to apply for residency, let us know so we can help and advise you. We want to know what stage of the process you are in, because with the President Biden's administration removed the Public Charge requirements, which was the No. 1 reason why they were denying the cases with the Trump administration.
Now that President Trump's Public Charge requirements have been removed, everything is back to the way it was before. That means that to make you a resident we need a person who is a resident or U.S. citizen who earns enough, who is financially responsible for you. It can be a friend or family member.
It doesn't matter how much you are earning, it doesn't matter how much the person asking you is earning, whether you are being asked by your spouse, a father, a brother, a mother or even a child. At the end of the day they focus on how much the person who is going to sign the financial responsibility is earning. That's the way this process has been going for decades. As we go back to the old rules, it's much easier in that regard.
Under the Trump administration, if you needed something they didn't have to ask you for it, they could deny you the case right off the bat and put you on deportation process. Now, under President Biden they send you for the tests, they give you a chance and you can submit them. It's not a step before deportation proceedings.
You can take a risk. If there is something in your case that we as lawyers for example are not sure about, if there is a risk, we can still make the attempt. We know that are generally not placing people in deportation proceedings..
Now is the time to try, not only because it is easier since we are going back to the previous Public Charge rules, but also because Immigration will give you the opportunity to submit more evidence, to meet any requirements. We have a second and third chance with Immigration if necessary, before they will deny your case.
