Greetings Jorge Rivera, immigration attorney.

Friends, family and dreamers: it is important that you pay attention to this news, because are not approving new applications for dreamers under DACA. They are not going to give them a work permit until this whole problem is resolved in the Cortes.

Nine states filed a lawsuit in the Federal Court against DACA. The Judge Andrew Hanen basically gave the order that they can receive new applications, but not approve them.

Why apply?

Now, if they are not approving the work permit for people applying for the first time, and the renewals are being approved, so what are we going to apply for?
The President Joe Biden's administration is fighting for the Dreamers. They appealed to the Federal Court, and may continue to appeal all the way to the Supreme Court until they are able to fully unblock DACA. Immigration's recommendation is that they apply for the first time even if they are not being approved.

Why is DACA not enough?

DACA is not enough because it is not a law passed by Congress, it's hardly an executive order started by President Obama that President Trump tried to end, but continued and now President Biden wants to reinstate it in full. However, it is always going to be in question because it is no law.

Right now there is no chance that they will pass a law for dreamers because it is not even being considered anymore. So, dreamers, let's look for a way to the residence.
