There is a punishment of 10 years for having entered undocumented or having remained undocumented in the country. And that is why people have to go out and ask for a pardon inside the U.S., and go to their appointment at the U.S. Embassy.
The problem is that many people think that because 10 years have passed since their arrival, they no longer have to worry about forgiveness. But that is not true, it is a myth. You have to serve the 10 years outside the U.S. so that you no longer have to ask for a waiver.
Remember: there are different punishments for different violations.
For example, the deportation has a penalty that requires an I212 Waiver. Undocumented entry or stay has a waiver called a "1601".
