Greetings Jorge Rivera, immigration attorney.
If you are a dreamer or know a dreamer because you are the parent, friend or family member, pay attention to this news. I will give you the details of how dreamers can jump from having only a work permit with DACA to residency.
The problem is that many dreamers have entered undocumented at the border. Our recommendation is that they ask for a travel permitIf you have a U.S. citizen child over the age of 21, they can leave and have that entry count as a legal entry. Then, if a U.S. citizen child over 21 applies for them, they go straight to the residence.
The same would be true for a U.S. citizen wife or husband who asks for legal entry. We don't have to ask for a pardon, we don't have to leave the country, there is no punishment. If you are a dreamer, ask for a travel permit and take out the legal entry. And if you are a boyfriend or girlfriend of an American citizen, look into the possibility of getting married (obviously for love, not for the papers) so we can have a direct path to residency.
The important thing is not to fit exclusively into DACA and stay with the doubt to see what happens. Don't let DACA define you, don't think "I'm a dreamer and that's it". Let's look for other alternatives, for example: Are you a victim of a crime? Can you qualify for the U Visa? Are you a victim of domestic violence? You may qualify for VAWA. The work permit you already have it, so we don't have to ask for a deferred action.
Remember: the focus is on how we get to the residence.
Do you qualify under the ten-year law? That is another alternative. Has anyone had you before, do you have a previous Immigration case? Let's explore possibilities.
If you are a dreamer, let me know, we will be in communication and look for solutions.
